The Chilean Congress of Argentina officially promulgated and took effect on May 20 this year, “Law No. 21,642” (Ley 21.642), which comprehensively and strictly regulates the sale, promotion and use of e-cigarette products in public places. The core of this legislation is to effectively protect the physical and mental health of the youth group, while balancing the reasonable needs of adult consumers, and creating a safer and more orderly market environment through legal means.

The new law explicitly prohibits all sales of any type of e-cigarette products and accessories to minors under the age of 18, covering nicotine and non-nicotine e-cigarettes. This provision fills the gap in the previous regulations on the protection of minors and provides a solid legal barrier for young people to avoid the potential addiction risks of e-cigarettes.

In terms of advertising, the regulations strictly restrict e-cigarette advertisements to appear only in closed sales venues, and require that the content of the advertisements must not be visible in public areas through windows or other means, and must be within 400 meters away from schools, kindergartens and medical institutions. This move not only protects the publicity rights of merchants, but also effectively prevents minors from being attracted by brand marketing invisibly.

At the same time, the Chilean government treats the use of e-cigarettes as traditional cigarettes and prohibits the use of e-cigarettes in all closed public places, including public transportation, office buildings, restaurants and bars. This provision is intended to protect the air quality and health rights of non-smokers and keep the social use environment of e-cigarettes consistent with that of cigarettes.

The law also imposes strict requirements on the packaging of e-cigarette products. All e-cigarette and e-liquid packaging must be marked with the warning “Electronic nicotine delivery systems are potentially addictive and are only sold to people over the age of 18”. At the same time, the ingredients, manufacturer information and use risk warnings should be clearly listed to ensure that consumers can fully understand the product attributes and possible hazards.

At the law enforcement level, the Chilean Ministry of Health and the Regional Health Secretariat (Seremi) will assume the responsibility of supervision and inspection, and impose fines, confiscation of products and even revocation of business licenses on businesses and manufacturers that violate the regulations. The specific amount of the fine is divided according to the severity of the violation. Among them, failure to mark the health warning on the packaging can be fined up to 34 million pesos, and repeated violations of sales to minors will also face severe sanctions.

For e-cigarette brands like GUUTUU that actively embrace compliance and innovation, the new law is undoubtedly good news. As early as last year, GUUTUU deployed localized production and warehousing in the Chilean market, completed ingredient testing and label design in strict accordance with regulatory requirements, and reached strategic cooperation with multiple closed retail channels, so that it can achieve a smooth transition at the beginning of the implementation of the regulations.

GUUTUU brand adheres to the concept of “technology-based, quality first”, and has been committed to providing adult consumers with a safer and more reliable e-cigarette experience. The product traceability and risk warning system required by the new law happens to be the core advantage of GUUTUU’s many years of practice. This not only enhances the brand’s credibility, but also wins the trust of more loyal users in the competition.

With the implementation of regulations, the Chilean e-cigarette market will further develop in the direction of compliance and specialization. For the industry, this is an opportunity for the survival of the fittest-only companies that can fully comply with regulations in production, publicity and channel management can stand out in the new round of competition. With its mature compliance mechanism and perfect quality system, GUUTUU will continue to lead the industry forward in a healthy and orderly manner.

From a public health perspective, prohibiting minors from purchasing and restricting their use in public places is expected to effectively curb young people’s attempts at e-cigarettes in the medium and long term and reduce the social accessibility of e-cigarettes; at the same time, for adult consumers, they can obtain the required nicotine replacement products in a safer and standardized environment, achieving the harm reduction or withdrawal assistance function of tobacco dependence.

In addition, the law sets limits on advertising, but does not completely prohibit it. Controllable promotion channels in closed places enable brands to communicate with adult consumers in a more professional and responsible manner, providing product knowledge, usage guidance and risk warnings. This model not only protects minors, but also provides space for positive publicity for legal brands, which helps the entire industry to continue to innovate and develop under public supervision.

On the economic level, the implementation of regulations will encourage more e-cigarette production lines, testing laboratories and logistics warehousing to move to localization, thereby driving an increase in employment opportunities and optimization of the supply chain. GUUTUU’s local production base in Chile has begun to expand its production capacity and plans to recruit more technical and quality inspection personnel in the coming months to inject new vitality into the local economy.

In summary, the new Chilean e-cigarette law focuses on “protecting the health of minors” and is guided by “regulating industry development” and “supporting legal innovation”, achieving a reasonable balance between restriction and openness. Responsible brands like GUUTUU will rely on their own advantages, comply with regulatory requirements, and help the Chilean e-cigarette market move towards a healthier, orderly and sustainable future through high-quality and compliant products and professional marketing.
