At Oakdale Agricultural School in South Africa’s Western Cape province, two tenth-grade students were severely disciplined for vaping in their dormitory. The school revoked their scholarships, leadership positions, and sports memberships. However, the Western Cape High Court recently ruled that the school’s disciplinary procedures were unlawful and invalidated all penalties.
The two students, L and M, were both members of the school’s rugby team and enrolled on scholarships. They were first caught vaping in their dormitory in November 2023, and the school grounded them for six weeks in accordance with school regulations.
However, in August 2024, they were caught vaping again in their dormitory. The school immediately expelled them permanently from the dormitory and, a few weeks later, imposed further punishment for the same incident, revoking their scholarships, leadership positions, and sports memberships.
M’s father complained to the school about the incident but was told he had no right to appeal. Ultimately, the court found serious flaws in the school’s disciplinary procedures, violating the principle of “double jeopardy,” and ruled that all disciplinary actions were invalid.

The court noted that while vaping violated school rules and regulations, the school’s repeated disciplinary actions against the student for the same incident constituted repeated punishment and violated legal provisions. Furthermore, the court found that the school’s punishments were excessively harsh, potentially adversely affecting the student’s future and lacking educational value.
This ruling not only secured justice for L and M but also provides important legal guidance for disciplinary actions in other South African schools. It emphasizes that schools must follow legal, fair, and appropriate procedures when handling student misconduct and avoid excessive punishment.
