On April 9, 2025, the U.S. House of Representatives Oversight and Government Reform Committee held a hearing entitled “Restoring Trust in FDA: Rooting Out Illicit Products”, focusing on the Federal Food and Drug Administration (FDA)’s regulatory performance in combating illegal e-cigarettes and counterfeit and substandard products. Republican lawmakers generally attributed the proliferation of illegal products on the market to the FDA’s red tape during the Biden administration, believing that the FDA set too high a threshold in the approval path, thereby stifling the innovation opportunities of local companies in the field of flavored e-cigarettes other than vanilla and menthol, and allowing a large number of disposable flavored products made in China to take advantage of the situation. At the same time, Democratic lawmakers expressed concern about the current government’s large-scale layoffs of senior FDA employees, pointing out that this move weakened the FDA’s professional enforcement capabilities and could lead to a gap in public health protection.

“Under the current FDA regulatory system, almost 90% of e-cigarette products sold on the market are unauthorized. These products are usually not subject to quality and safety review, but they cater to the urgent needs of adult smokers.” Bentley emphasized in his testimony that the formal approval process takes an average of nearly three years, far exceeding the statutory 180-day initial review period. This delay not only affects the possibility of adult smokers turning to safer alternatives, but also provides a broad living space for illegal supply chains.
Members generally agree that increasing the product diversity of the legal market is crucial to reducing adult users from purchasing products through gray channels. At the state level, Florida Attorney General Ashley Moody severely criticized the size of the state’s illegal e-cigarette market at the confirmation hearing of FDA Commissioner Marty Makary. According to statistics from the local Retail Federation, in 2024 alone, more than 363 million US dollars of illegal e-cigarette products will flow into the consumer market in Florida, far higher than the national average, triggering calls from all parties to strengthen interstate cooperation and federal supervision.
Several witnesses also pointed out that the warning letters issued by the FDA alone are not enough to deter illegal manufacturers, and they should be given more power to seize products and file civil fines.
